Subpoenas

Subpoenas for production of documents or other items should be issued to

The Proper Officer, Environment Protection Authority
6 Parramatta Square, 10 Darcy Street, Parramatta NSW 2150

Subpoenas can be served on the EPA

Subpoenas to give evidence in court issued to a person in their capacity as an officer of the EPA should be addressed to that officer, not the EPA.

Costs of production

Subpoenas for production must be accompanied by $100 in conduct money paid by electronic funds transfer (email legalservices.digitalmail@epa.nsw.gov.au for bank details)

The EPA may also seek to recover any further costs and expenses it incurs in complying with a subpoena to produce.

Costs for court attendance

Conduct money to cover witness expenses must be provided with a subpoena to give evidence. This may include the costs of travel and any accommodation associated with attending court.
